What is the difference between limited and unlimited employment contracts in the UAE?
Under Federal Decree-Law No. 33 of 2021, all employment contracts in the UAE are now fixed-term (limited) contracts with a maximum duration of 3 years, renewable. The previous "unlimited contract" category has been phased out. All existing unlimited contracts were required to be converted by February 2023.
Is it mandatory to register employment contracts with MOHRE?
Yes. Every employment contract for Mainland companies must be registered with the Ministry of Human Resources and Emiratisation (MOHRE) through the official portal. Free Zone employees follow the regulations of their specific Free Zone authority. Failure to register can result in fines and legal complications.
What is the Wage Protection System (WPS) and is it mandatory?
The WPS is a UAE government initiative that requires all employers to pay employee wages through approved banks, exchange houses, or financial institutions. It is mandatory for all private-sector companies registered with MOHRE. Non-compliance can lead to penalties, suspension of work permits, and legal action.
What are the Emiratisation requirements for private-sector companies?
Under the Nafis programme, private-sector companies with 50 or more employees must meet annual Emiratisation targets — currently a 2% annual increase in UAE national employees in skilled roles. Non-compliance results in fines of AED 96,000 per unfilled position per year.
